By booking a transfer service with ISTAirportShuttle.com (Sindibad Turizm Ticaret Anonim Şirketi), you agree to the following comprehensive terms and conditions. These terms are designed to ensure a safe, fair, and transparent experience for all parties.
1. Service Provision & Responsibilities
- Punctuality: We commit to providing timely and professional transfer services. Our chauffeurs will arrive at the designated pick-up location at the agreed-upon time.
- Flight Monitoring: For airport pickups, we monitor flight arrival times to accommodate reasonable delays. It’s crucial for clients to provide accurate flight details during booking.
- Vehicle & Chauffeur Standards: All our vehicles are regularly inspected and maintained to high safety and comfort standards. Our chauffeurs are licensed, experienced, and committed to professional conduct.
- Scope of Service: The service includes direct transportation from the pick-up to the drop-off location as specified in your booking. Additional stops may incur extra charges and must be pre-arranged.
2. Client Responsibilities
- Punctuality: Clients are responsible for being ready at the designated pick-up location at the confirmed time.
- Information Accuracy: Clients must provide accurate and complete information, including flight numbers, contact details, and pick-up/drop-off addresses. Inaccurate information may lead to service delays or cancellation without refund.
- Luggage: Clients are responsible for ensuring their luggage fits within the vehicle’s capacity. Any excess luggage not declared during booking that cannot be accommodated may require an additional vehicle at the client’s expense.
- Respectful Conduct: Clients are expected to treat the vehicle and chauffeur with respect. Disruptive, illegal, or unsafe behavior may result in the termination of the service without refund.
3. Damages to Vehicles
- Client Liability: Any damage caused to our VIP vehicles (including, but not limited to, upholstery tears, broken fixtures, excessive spills, or defacement) by clients during the transfer will be the sole financial responsibility of the client(s).
- Assessment & Payment: The cost of repairs or replacement will be assessed by our company, and the client will be liable for immediate payment. In cases of dispute, the regional courts in Istanbul, Turkey, shall have jurisdiction.
4. No-Show & Missed Flights Due to Client Delay
- Client Delay: If a client is not ready at the confirmed pick-up time and location (beyond any complimentary waiting time, as per our Refund Policy), and the transfer cannot proceed, our company will not be held responsible.
- Missed Flights: If a client misses their flight due to their own delay or failure to be ready for the transfer at the agreed-upon time, our company is not liable, and no refund will be issued for the unused transfer service.
5. Our Liability for Missed Flights
- Company Responsibility: Should a client miss their flight directly due to a demonstrable fault or delay on the part of our company (e.g., chauffeur’s unexcused lateness, vehicle breakdown not caused by external factors), our company will compensate the client for the direct and reasonable cost of a new flight ticket for the same route and class.
- Exclusions: Our liability is strictly limited to the direct cost of the replacement flight ticket and does not extend to consequential damages such such as lost income, missed connections for subsequent travel, or accommodation costs.
6. Extraordinary Circumstances & Force Majeure
- Unforeseen Events: Our company shall not be held liable for delays, missed transfers, or any other service disruptions caused by extraordinary circumstances beyond our reasonable control. This includes, but is not limited to, severe traffic accidents leading to road closures, extreme weather conditions, natural disasters, acts of terrorism, civil unrest, or other force majeure events.
- Efforts to Mitigate: In such unforeseen situations, we will make every reasonable effort to mitigate the impact, find alternative routes, or provide assistance, but without assuming liability for the delay or missed service.
7. Dispute Resolution
- Any disputes arising from these Terms and Conditions shall be governed by the laws of the Republic of Turkey.
- The regional courts in Istanbul, Turkey, shall have exclusive jurisdiction over any such disputes.
